Legal Challenge Filed Against Chief Justice’s Removal Process in Ghana

Vincent Ekow Assafuah, a citizen of Ghana and the Member of Parliament for Old Tafo, has today filed a Writ against the Attorney-General in relation to the petitions for the removal of the Chief Justice.

Specifically, the plaintiff seeks, among others, a declaration mandating the President of Ghana, H.E John Dramani Mahama, to notify the Chief Justice about the three petitions filed for her removal and obtain her comments and responses before referring the petition to the Council of State or commencing the constitutionally sanctioned consultation processes.

According to the Plaintiff, the failure of the President to give this said notice should render the consultative processes initiated by the President null and void.

The plaintiff also contends that such a failure could undermine the security of tenure of the Chief Justice and lead to an unjustified interference with the independence of the judiciary, enshrined in the constitution.

Representing the Plaintiff in this action, is the former Attorney General of Ghana, Godfred Yeboah Dame.
