In line with Article 144 (3) of the Constitution, 1992, the President of the Republic, John Dramani Mahama, has nominated some distinguished members of the legal community- comprising serving Justices of the High Court and private legal practitioners – to the Court of Appeal.
They include Apangano Achibonga, Richmond Osei Hwere, Kwasi Anokye Gyimah, Olivia Owusu and Franklina Adanu.
Following their nominations by the President, the Judicial Council shall as a matter of law consider and approve the nominees before swearing in.
Of noteworthy is that the current nominees when approved and sworn into office would bring the number of Justices of Appeal to about 53.
The Court of Appeal is the second highest court of the land after the Supreme Court. Its main function under Article 137 of the Constitution is the hearing and determination of appeals emanating from the lower courts and the High Courts, and such other appellate jurisdiction as may be conferred on it by the Constitution or any other law.
The Court of Appeal unlike High and Supreme Courts, is also bereft of original jurisdiction. However, in parliamentary election disputes, it acts as the final court.
