Following the commencement of criminal proceedings against Mr. Kwabena Adu Boahen and three others on Wednesday, 30th April 2025, the High Court (General Jurisdiction 10), Accra, convened a closed-door (in camera) session in the early hours of Thursday, 2nd May 2025. The purpose of the hearing was to determine whether the first accused, Mr. Kwabena Adu Boahen, should continue to enjoy bail or be remanded into lawful custody.
The in camera proceedings were initiated upon the directive of the Court after the Honourable Attorney-General raised concerns regarding potential interference with prosecution witnesses by the first accused.
During the hearing, counsel for the accused persons urged the Court to maintain the existing bail conditions for all four accused persons. The Attorney-General, however, opposed the continuation of bail in respect of Mr. Adu Boahen, submitting that there were credible and substantiated concerns that the first accused might interfere with key witnesses should he remain at liberty.
The Attorney-General further emphasised the need to preserve the integrity of the investigative and prosecutorial process, and accordingly prayed the Court to remand the first accused for a period of fourteen (14) days to allow for the unhindered finalisation of witness statements and related processes.
Having carefully considered the submissions of both counsel for the accused and the Attorney-General, the Honourable Court, presided over by His Lordship Justice Eugene Nyante Nyadu, ruled that the first accused be remanded into custody for a period of seven (7) working days. This remand, the Court held, would facilitate the proper completion of prosecution witness statements without the risk of undue influence or obstruction.
The Court, however, allowed the second and third accused persons to remain on their existing bail terms.
The matter has been adjourned to Tuesday, 13th May 2025, for further proceedings.
