President Removes Chief Justice Torkornoo Under Article 146

President John Dramani Mahama has, in strict accordance with Article 146(9) of the 1992 Constitution, removed the Chief Justice, Her Ladyship Justice Gertrude Araba Esaaba Sackey Torkornoo, from office with immediate effect. The decision follows the receipt of a report by a Committee constituted under Article 146(6) to investigate a petition lodged by a Ghanaian citizen, Mr Daniel Ofori. The Committee, upon considering the petition and evidence, found that the constitutional grounds of stated misbehaviour under Article 146(1) had been established and consequently recommended her removal.

By virtue of Article 146(9), the President is constitutionally bound to act in accordance with the Committee’s recommendation, leaving no discretion in the matter. This constitutional requirement has now culminated in the removal of the Chief Justice, marking a watershed moment in Ghana’s constitutional and judicial history.
